Please note the following information regarding the point of impact and the liability of Leica Camera AG (“LEICA”)
The Calonox 2 Sight/Calonox 2 Sight LRF (hereinafter “Calonox”) is factory-set so that the point of impact can be subject to deviations of up to 5 cm at 100 m. Furthermore, deviations in the point of impact may occur as a result of the entire system used (e.g. weapon, mount, adapter, riflescope), also depending on the quality of the riflescope and adapter used, as well as the type of mounting and the changed center of gravity, or due to the addition of additional weight to the riflescope optics.
The Calonox supports safe and responsible hunting. You must always evaluate your surroundings, the area around the target and in between, as well as the current general situation and its variability; therefore you retain responsibility for your shot. You also have the responsibility to check and ensure that the entire system works perfectly together with the Calonox.
LEICA recommends that you familiarize yourself with the device before using the Calonox on the shooting range or in the field. Also check that the overall function of the equipment and the location of the point of impact are correct. LEICA also recommends that you regularly compare all settings with real shots in a safe environment (e.g. a shooting range) before using it for hunting and adjust the settings based on your own independent assessment of "if" and "how". Calonox users assume full responsibility for the use of all functions.
LEICA's liability for damages arising from the use of the Calonox is excluded, subject to the exceptions set out below. This exclusion does not apply to damages that arise from an intentional breach of duty or gross negligence on the part of LEICA or a legal representative or vicarious agent of LEICA. In the event of a simple or minor breach of duty on the part of LEICA or a legal representative or vicarious agent of LEICA, LEICA is liable only (a) - but without limitation - for damages resulting from injury to life, body or health; as well as (b) for damages resulting from the breach of essential contractual obligations (essential contractual obligations are those obligations whose fulfillment enables the proper execution of the contract in the first place and on the observance of which the customer regularly relies and may rely); In these cases, LEICA's liability is limited to the amount of damages that are typical for the contract and foreseeable at the time of conclusion of the contract. The limitations of liability set out in the preceding case do not apply if LEICA has fraudulently concealed a defect or has provided a guarantee for the quality of the goods with a guarantee for damages. Furthermore, any mandatory legal liability, in particular under product liability legislation, always remains unaffected.
